Supreme Court Rules Unanimously in Favor of Trump Administration in Asylum Case
The United States Supreme Court has delivered a unanimous ruling backing the Trump administration’s immigration policy, deciding that federal appeals courts must defer to immigration agencies’ findings on what constitutes “persecution” in asylum cases.
The case, Urias-Orellana et al. v. Bondi, originated from the asylum applications of Douglas Humberto Urias-Orellana, his wife, and their minor child, who entered the United States from El Salvador in 2021.
The family claimed they were targeted by a hitman in their home country. However, an Immigration Judge and the Board of Immigration Appeals (BIA) determined that they had not established a well-founded fear of future persecution as required under the Immigration and Nationality Act (INA).
In its ruling on Wednesday, the Supreme Court held that appellate courts must apply the “substantial-evidence” standard of review to the BIA’s determinations. The decision prevents federal judges from conducting fresh reviews of undisputed facts to determine asylum eligibility.
“Courts of appeals must apply the restrictive substantial-evidence standard to the BIA’s determinations. Federal courts cannot conduct a de novo review of whether facts qualify as persecution,” the Court stated.
The justices further noted that the record in this specific case did not compel a finding contrary to the agency’s initial denial of asylum.
Following the decision, the Department of Homeland Security (DHS) issued a statement on its official X handle welcoming the ruling.
“This is a win for the American people, the rule of law, and common sense,” the statement read. “For years, activist judges have used the federal judiciary to shield illegal aliens from deportations, simply because those illegal aliens could make false persecution claims often from scripts provided by open-border NGOs even when the Board of Immigration Appeals ruled no such fears were credible.”
The department added that the administration would continue its efforts to deport undocumented individuals and maintain national security.
