El-Rufai’s Temporary Release for Mother’s Burial Must Be Backed by Court Order — Deji Adeyanju

Human rights lawyer and activist, Deji Adeyanju, has described the decision to grant former Kaduna State governor, Nasir El-Rufai, temporary release from the custody of the Independent Corrupt Practices Commission (ICPC) to attend his mother’s burial as humane and commendable. However, he stressed that such a move must be supported by a valid court order.

In a statement issued on Saturday, Mr Adeyanju reacted to reports that Mr El-Rufai was allowed to leave ICPC custody temporarily to participate in the burial rites of his late mother.

The activist noted that while the gesture by authorities reflects compassion and respect for human dignity, it must strictly comply with the law since the former governor was remanded in custody by a court order.

“The decision to grant Mallam Nasir El-Rufai temporary release from Independent Corrupt Practices Commission custody to attend his mother’s burial is both humane and commendable but must be backed by a court decision or order since he was remanded in custody on the order of the court,” Mr Adeyanju said.

The lawyer explained that the development represents a balance between the enforcement of justice and the recognition of fundamental human values, particularly during moments of personal loss. He noted that the decision demonstrates that authorities can enforce the law while also showing empathy in exceptional circumstances.

“The decision to allow El-Rufai to attend his mother’s funeral reflects a necessary balance between the demands of justice and respect for fundamental human dignity,” he added.

Mr Adeyanju also cautioned against misinterpreting temporary release or bail arrangements in such situations as an attempt to evade accountability. He emphasised that lawful accommodations exist within the justice system for deserving circumstances.

“Bail, whether administrative or judicial, should not be misconstrued as an escape from accountability, but rather as a lawful and compassionate accommodation in deserving circumstances,” he said.

He maintained that while the rule of law must remain paramount, acts of compassion within the legal framework strengthen public confidence in institutions and reinforce the principle that justice can be firm yet humane.

“This action by the authorities is a welcome demonstration of empathy while upholding the rule of law,” Mr Adeyanju stated.
